New Jersey Adult Guardianship — Judgment of Incapacity and Appointment of Guardian(s) of the Person and Estate is a legal process through which the court reviews the case of an adult who has been declared legally incapacitated and appoints a guardian to manage their affairs. The court has the authority to appoint both a guardian of the person (to make decisions about the individual’s physical health and well-being) and a guardian of the estate (to manage the individual’s financial matters). The guardian of the person may also be granted the authority to make certain decisions about the individual’s medical care. There are two types of New Jersey Adult Guardianship — Judgment of Incapacity and Appointment of Guardian(s) of the Person and Estate: 1. Voluntary Guardianship — This type of guardianship is initiated by the incapacitated individual or their family and allows the court to appoint a guardian of the person and/or estate on behalf of the individual. 2. Involuntary Guardianship — This type of guardianship is initiated by the court and requires a doctor to evaluate the individual and provide a written evaluation that supports the finding of incapacity.
