New York Appendix A: Checklist for filing an Andes brief is a form provided by the New York State Appellate Division to aid attorneys in filing an Andes brief. An Andes brief is a document filed by a defense attorney to notify the court that the appeal is without merit and that the attorney can no longer ethically represent the defendant. The checklist is divided into two parts. In Part, I, the attorney must complete a section regarding the legal representation of the appellant and provide a statement that the appeal is without merit. In Part II, the attorney must provide a detailed list of the claims and issues that the attorney believes are without merit and the reasons for the attorney’s conclusion.
