Oklahoma Second Degree — Elements is a criminal offense in the state of Oklahoma. It is defined as the intentional and/or reckless infliction of serious physical injury upon another person. In order to be convicted of this offense, the following elements must be proven: 1. Intentional and/or Reckless Conduct: The defendant must have acted intentionally or recklessly when causing the physical injury. 2. Serious Physical Injury: The defendant must have caused serious physical injury to the victim. Serious physical injury is defined as any physical injury that creates a substantial risk of death, causes serious disfigurement, or causes protracted loss or impairment of the function of any bodily organ or member. 3. Resulting Injury: The physical injury must have been the direct result of the defendant’s conduct. There are two types of Oklahoma Second Degree — Elements: first degree and second degree. First degree is the most serious of the two and is punishable by up to 15 years in prison. Second degree is punishable by up to 10 years in prison.
