The Pennsylvania Petition For Relief From Conviction-Sentence (Person In State Custody) is a legal process that allows a person in state custody to seek relief from a conviction and/or sentence. This process is available to individuals who have been convicted and sentenced in Pennsylvania, and are currently serving their sentence in a Pennsylvania correctional facility. There are three types of Pennsylvania Petition For Relief From Conviction-Sentence (Person In State Custody): Post Conviction Relief, Direct Appeal, and Habeas Corpus. Post Conviction Relief allows a person to challenge their conviction and/or sentence by filing a petition in the court in which their conviction was entered. A Direct Appeal is a motion that can be filed with the Appellate Court to review the conviction or sentence. Lastly, a Habeas Corpus petition is a civil action where a person can challenge the legality of their confinement. All of these petitions must be filed within the time period specified by Pennsylvania law, or they will be dismissed.
