In Pennsylvania, with the exception of some DUI offenses if you are charged with a misdemeanor or felony you have the right to a jury trial.

Rule 1007.1 - Jury Trial. Demand. Waiver (a) In any action in which the right to jury trial exists, that right shall be deemed waived unless a party files and serves a written demand for a jury trial not later than twenty days after service of the last permissible pleading.

In criminal cases, a jury determines whether a defendant is guilty or not guilty and, in some cases, determines a penalty. The judge is responsible for formally sentencing the defendant at a later hearing. In a civil case, the jury determines whether a plaintiff has proven the case and what, if any, damages to award.

Rule 587 - Motion for Dismissal (a)Untimely Filing of Information. (1) Upon motion and a showing that an information has not been filed within a reasonable time, the court may order dismissal of the prosecution, or in lieu thereof, make such other order as shall be appropriate in the interests of justice.

(3) An answer with or without new matter may be filed within 20 days of service of preliminary objections, and a reply to new matter may be filed within 20 days of service of the answer.

(a) General rule. --Except where the right to trial by jury is enlarged by statute, trial by jury shall be as heretofore, and the right thereof shall remain inviolate. Trial by jury may be waived in the manner prescribed by general rules.

(c) A response to a dispositive motion shall be filed within 30 days of service of the motion or, if a supporting party files a memorandum of law alone, within 30 days of service of that memorandum of law.

Typically, a plaintiff will make its demand in the complaint filed at the outset of the case, and a defendant usually will make its demand in an answer to the complaint. If either party asks for a jury, the trial will be by jury.
