The Pennsylvania Waiver of Counsel-Spanish (Waiver de Abogado de Pensilvania-Español) is an official form that can be used by Spanish-speaking defendants in Pennsylvania to waive their right to an attorney. It is necessary for a defendant to complete this form if they wish to proceed with their case without the assistance of a lawyer. The waiver must be signed by both the defendant and the judge. There are two types of Pennsylvania Waiver of Counsel-Spanish: the Simplified Waiver of Counsel-Spanish and the Full Waiver of Counsel-Spanish. The Simplified Waiver of Counsel-Spanish is used when a defendant wishes to represent himself/herself without the assistance of an attorney, and is sufficient for cases with minimal complexity. The Full Waiver of Counsel-Spanish is used when a defendant wishes to represent themselves in more complex cases, and requires the defendant to demonstrate a greater understanding of the legal proceedings and the consequences of waiving their right to counsel.
