Manufacture and distribute a controlled substance (21 U.S.C. Sec. 841(a) & (b)) is the process of producing, packaging, and/or distributing a controlled substance. According to federal law, it is illegal to manufacture, distribute, or possess a controlled substance without the proper authorization from the Drug Enforcement Administration (DEA). The two primary types of manufacture and distribution of a controlled substance are: (1) Manufacturing for the purpose of distribution and (2) Distribution of a manufactured controlled substance. Manufacturing for the purpose of distribution includes producing a controlled substance through the use of chemical synthesis, extraction, compounding, or other processes. This type of manufacture includes all stages of production from the initial synthesis to the sale, delivery, or distribution of the final product. Distribution of a manufactured controlled substance includes all steps necessary to transport, deliver, or deliver the controlled substance to its intended destination. This includes transporting the substance from a production facility to a distributor, wholesaler, or retailer, as well as delivering it to a final consumer. Any person or entity engaging in the manufacture or distribution of a controlled substance must comply with the requirements of 21 U.S.C. Sec. 841(a) & (b). Failure to comply with these requirements can result in criminal penalties and/or civil liability.
