Breach is the failure to perform a duty. Causation is a link between the breach of duty and the injury suffered by the claimant. Injury is any physical, mental, or financial harm suffered by the claimant. Damages are the monetary compensation that is awarded to the claimant as a result of the breach of duty. Scope of liability is the extent to which the defendant is legally responsible for the injury suffered by the claimant. The statute of limitations is the time limit within which a claim must be filed.
