A Georgia Self-Proving Affidavit is a legal document used in the state of Georgia to provide evidence of a valid will without having to present witnesses in court. This affidavit is typically signed by two witnesses in the presence of a notary, and it attests to the fact that the signers are aware of the will and have signed it in the presence of the testator (the person making the will). There are two types of Georgia Self-Proving Affidavits: a Regular Self-Proving Affidavit and an Out-of-State Self-Proving Affidavit. The Regular Self-Proving Affidavit is used when both witnesses and the testator are present in Georgia when the document is signed. The Out-of-State Self-Proving Affidavit is used when either the witnesses or the testator are located outside of Georgia. Both types of affidavits must be signed in the presence of a notary to be valid.
