Motion for Authorization to File Successive Application (Sec. 2244) is a type of legal motion filed in the United States federal court system. It is a motion that a prisoner can file in order to ask the court to authorize the filing of a successive application for relief under 28 U.S.C. § 2244(b)(3). This motion must be filed in the court of appeals of the circuit in which the prisoner's original case was decided. There are two types of Motion for Authorization to File Successive Application (Sec. 2244): 1. First or Original Motion: This is the initial motion filed by the prisoner in the Court of Appeals seeking authorization to file a successive application. 2. Successive Motion: This is the motion filed in the district court if the Court of Appeals authorized the filing of a successive application. This motion must be accompanied by the court of appeals order authorizing the successive application.
