CJA 23 — Financial Affidavit is a form used by the court to determine the financial ability of a criminal defendant to pay for their own defense. It is used to help the court determine whether a defendant qualifies for court-appointed counsel, and if so, the amount of compensation to be paid to the appointed counsel. There are three different types of CJA 23 — Financial Affidavit: the Standard Financial Affidavit, the Short Financial Affidavit, and the Adult Financial Affidavit. The Standard Financial Affidavit is the most comprehensive of the three and requires that the defendant provide detailed financial information, such as income, assets, liabilities, expenses and dependents. The Short Financial Affidavit is a simplified version of the Standard Financial Affidavit and requires fewer details. The Adult Financial Affidavit is only used for adult defendants and requires the same level of detail as the Standard Financial Affidavit.
