The civil rights violation must be related to the arrest, detention, or conviction and must have caused harm to the individual. There are three types of Civil Rights — 42 U.S.C. Sec. 1983 Claim— - Arrestee, Pretrial Detainee, or Convicted Prisoner Alleging Failure to Intervene: 1. Arrested: Claims brought by an individual who alleges that the state actor failed to intervene to prevent his/her arrest and that he/she was subjected to a violation of his/her civil rights as a result. 2.
