18 U.S.C. Sec. 1956 DEFINITION OF "PROCEEDS" is a section of the United States Code which defines the term “proceeds” as used in the context of money laundering. This section outlines the definition of “proceeds” in two different forms: (1) “proceeds” as the property derived from or realized through the commission of a criminal offense; and (2) “proceeds” as the property of equivalent value. In the first form, “proceeds” are defined as the gross receipts obtained from the commission of a criminal offense, including the gross receipts from any activity related to the criminal offense. In the second form, “proceeds” are defined as any property of a value equal to that of any proceeds obtained from the commission of a criminal offense. This section also includes a provision which states that the term “proceeds” shall not include any property acquired by a person as a result of a gift, bequest, devise, or inheritance.
