Sec. 892 EXTORTIONATE EXTENSION OF CREDIT — ELEMENTS is a Federal law that sets out the elements of a criminal offense related to extortionate extensions of credit. This law prohibits the use of extortionate means to collect an extension of credit or attempt to do so. Specifically, the law states that any person who knowingly participates in any way in an extension of credit with the use of extortionate means shall be fined, imprisoned, or both. The elements of an offense under 18 U.S.C. Sec. 892 EXTORTIONATE EXTENSION OF CREDIT — ELEMENTS are: 1. The accused knowingly participated in the extension of credit in some way; 2. The extension of credit was made with the use of extortionate means; and 3. The accused knew that the extension of credit was made with the use of extortionate means. The types of extortionate means described in the law include the use of threats of violence, physical force, or the use of a criminal act, such as threatening to report someone to law enforcement.
