12.9 ADA-Retaliation is a form of discrimination that is prohibited under the Americans with Disabilities Act (ADA). Retaliation occurs when a person is treated differently or negatively due to filing a complaint or opposing an unlawful practice under the ADA. Examples of ADA-Retaliation include: 1. Terminating, suspending, demoting, or denying a promotion to an employee due to filing a complaint or opposing an unlawful practice under the ADA. 2. Refusing to hire, or firing, an applicant or employee due to filing a complaint or opposing an unlawful practice under the ADA. 3. Refusing to make reasonable accommodations necessary for an employee with a disability due to filing a complaint or opposing an unlawful practice under the ADA. 4. Intimidating, coercing, or harassing an individual due to filing a complaint or opposing an unlawful practice under the ADA. 5. Denying employment benefits or other privileges of employment due to filing a complaint or opposing an unlawful practice under the ADA.
