8.59 Firearms-Unlawful Sale or Delivery (18 U.S.C. Sec. 922(b)(1)-(3)) is a federal law that prohibits the sale or delivery of firearms to any person who is not qualified to possess a firearm under federal or state law. This law applies to both sellers and purchasers and is punishable by imprisonment and/or fines. There are three types of unlawful sales or deliveries of firearms: 1. Selling or delivering a firearm to a person who is prohibited from possessing a firearm by federal or state law, such as a convicted felon. 2. Selling or delivering a firearm to a person in a state other than the one in which the seller is licensed to sell firearms. 3. Selling or delivering a firearm to a person who is under the age of 18. Violations of this law are punishable by a fine, imprisonment, or both. Additionally, sellers and buyers of firearms may be subject to additional state and local laws, such as background checks, that may further restrict the sale and delivery of firearms.
