An Advance Directive — Durable Power of Attorney is a legal document that allows an individual to appoint an agent to make medical and financial decisions on their behalf if they become incapacitated. The individual, known as the principal, is able to appoint an agent, known as the attorney-in-fact, to act on their behalf if they are unable to make decisions themselves. The principal is able to provide detailed instructions regarding the types of decisions the attorney-in-fact is able to make, such as financial and medical decisions, as well as the extent in which they are able to make decisions. There are two types of Advance Directive — Durable Power of Attorney documents: healthcare and financial. The healthcare Durable Power of Attorney document allows the principal to appoint an attorney-in-fact to make medical decisions on their behalf, such as consenting to or refusing medical procedures. The financial Durable Power of Attorney document allows the principal to appoint an attorney-in-fact to make financial decisions on their behalf, such as managing bank accounts and investments.
