The document typically includes the landlord’s consent to the assignment and the new tenant’s agreement to the sublease. There are two common types of Assignment, Assumption and Consent Agreement of Sublease: Direct Assignment and Assumption and Sublease Assumption Agreement. With a Direct Assignment and Assumption, the subtenant transfers all of their rights and obligations to the new tenant. With a Sublease Assumption Agreement, the subtenant remains liable for the obligations of the sublease, but the rights and obligations are transferred to the new tenant.
