A Utah Notice of Removal from Justice Court (Filed in District Court) is a formal legal document used to move a case from a justice court to a district court. The Notice of Removal must be filed with the district court clerk within 10 days of the defendant receiving service of the Complaint or Summons. The Notice of Removal is also served on the plaintiff and filed with the justice court. There are two types of Utah Notice of Removal from Justice Court to District Court: 1) Voluntary Notice of Removal: This type of Notice is filed by agreement of both parties and allows the case to be transferred to the district court without objection. 2) Involuntary Notice of Removal: This type of Notice is filed by one party without the agreement of the other. The party filing the Notice must provide a written statement of facts demonstrating that they are entitled to have the case transferred to the district court. The other party may then file an objection to the Notice of Removal within 10 days of service.
