Virginia Waiver of Notice of Probate or Qualification is a document required by the Commonwealth of Virginia in order to waive the requirement of notice of probate or qualification for an estate. The waiver allows the executor and other interested parties to proceed with the probate or qualification process without having to send the required notice to all interested parties. There are two types of Virginia Waiver of Notice of Probate or Qualification: (1) Waiver of Notice of Probate of Will and (2) Waiver of Notice of Qualification. The Waiver of Notice of Probate of Will is used when the executor of an estate has been appointed and notice of probate must be sent to interested parties. The Waiver of Notice of Qualification is used when the executor of the estate has not been appointed and the qualification process must begin. In both cases, the waiver must be signed by the executor or the person making the request for the waiver, and must be filed in the appropriate court.
