Washington Findings of Fact and Conclusions of Law for an Exceptional Sentence (Appendix 2.4A Judgment and sentence) (Optional) is a form that allows a judge to make detailed findings of fact and conclusions of law to support an exceptional sentence. This form allows the judge to explain the reasons for imposing an exceptional sentence on an offender. The form lists the factors that the judge must consider in making a decision, including the offender's criminal history, the seriousness of the offense, the nature of the harm caused by the offense, and the amount of restitution that is appropriate. Additionally, the court must consider any mitigating or aggravating circumstances, such as the offender's mental health, the need for rehabilitation or deterrence, and the availability of alternative sanctions. The form also requires the judge to list any aggravating or mitigating factors that the court relied upon in determining the exceptional sentence. This form is used by judges in Washington when an offender is sentenced to an exceptional sentence that is outside the standard sentencing range.
