The Wisconsin Petition for Examination (Fifth Standard under 51.20(1)(a)2.e.) is a document filed by an individual or business entity with the Wisconsin Department of Financial Institutions in order to initiate a formal examination of a financial institution. This petition must be in accordance with the criteria set forth in Wis. Stat. §51.20(1)(a)2.e. This statute provides that the petition must contain a statement that the petitioners have "good cause to believe that the financial institution is not in compliance with the applicable statutes, regulations, and safety and soundness standards prescribed by the department." The Wisconsin Petition for Examination includes two types of petitions: an Examination Petition and an Informal Hearing Petition. The Examination Petition is used by petitioners to request an examination of a financial institution by the department in order to determine if the institution is in compliance with applicable statutes, regulations, and safety and soundness standards. The Informal Hearing Petition is used by petitioners to request an informal hearing before the department to resolve any disputes or other matters regarding the financial institution. Both types of petitions require the petitioner to provide supporting information and documents to the department, including a detailed explanation of the issues being raised and the basis for the petition. The petition must also include a statement of the petitioners' interests in the matter. Upon receipt of the petition, the department may decide to initiate an examination or hearing, or deny the petition.
