Wyoming MCP 13. Order Setting Hearings are court proceedings in which a judge or magistrate hears evidence and arguments to decide whether to grant a petition for guardianship, conservatorship, or other protective order. There are two types of Wyoming MCP 13. Order Setting Hearings: contested hearings and uncontested hearings. Contested hearings occur when a petitioner and an alleged incapacitated person dispute the need for a guardianship or other protective order. Uncontested hearings occur when the parties agree that the guardianship or other protective order is necessary. In both types of hearings, the petitioner must present evidence to prove that the alleged incapacitated person is in need of a guardian or other protective order. The judge or magistrate must then determine whether the guardianship or other protective order is in the best interests of the alleged incapacitated person.
