California Eviction Notice to Quit If the lease does not provide for termination of the tenancy, the landlord must send the tenant a notice to quit, which will become the lease termination notice or quitclaim. The notice must provide the date the tenant must vacate the unit. Notice to quit does not have to be a specific time, but must be at some time between 15 days to three months after which the land lording can either terminate the tenancy or sue for eviction. (there notice requirement does not apply if the property is subject to rent control, which limits the amount that can be charged for renting a property to a specified price or term.) Note: Because the notice to quit must include a time between when the lease begins and when notice to vacate must be given before the tenant has ten days to vacate the unit, a tenant who receives a notice to quit before his lease begins may choose not to vacate the unit because of this requirement.
