A subtenant is someone who has the right to use and occupy rental property leased by a tenant from a landlord. A subtenant has responsibilities to both the landlord and the tenant. A tenant must often get the consent of the landlord before subletting rental property to a subtenant. The tenant still remains responsible for the payment of rent to the landlord and any damages to the property caused by the subtenant, unless the landlord agrees to release the tenant from liability.
Generally, to evict a roommate, you must be the original tenant (or the one who has signed a lease or rental agreement with the landlord), and the roommate you want to evict must be your landlord's subtenant. A subtenant is usually someone who is renting part of your place from you and paying rent to you instead of your landlord. In this relationship, you are the "landlord" and your roommate is your "tenant."
A tenant acting in the capacity of a landlord who resides in the same rental unit with his or her subtenant may be able to evict said subtenant without just cause, as required under some local landlord-tenant laws, which vary by locality. Depending on local law, a master tenant must give written notice to the subtenant a certain number of says in advance of eviction. If the subtenant doesn't leave, it may be necessary to file an unlawful detainer lawsuit.
Under some local laws, a tenant who subleases his or her rental unit may charge no more rent upon initial occupancy of the subtenants than that rent which the tenant is currently paying to the landlord. In other words, a master tenant cannot profit off of their landlord's property. Title: Minneapolis Minnesota Tenant's Detailed Complaint Letter to Landlord Regarding Unreasonable Sublease Refusal Keywords: Minneapolis, Minnesota, tenant, landlord, sublease, refusal, unreasonable Subject: Comprehensive Tenant's Complaint about Landlord's Unreasonable Sublease Refusal in Minneapolis, Minnesota Dear [Landlord's Name], I hope this letter finds you in good health and high spirits. Firstly, I want to express my gratitude for providing me with a comfortable living space in your Minneapolis property. However, I am writing to address a matter that has recently caused me significant inconvenience and disappointment. As you are aware, I have been a responsible and reliable tenant of your Minneapolis property for [X years/months]. Unfortunately, my current situation has taken an unexpected turn, compelling me to relocate from Minneapolis to [new location, if applicable] for professional reasons/family obligations/financial circumstances [choose one or provide your own]. Consequently, I am left with no choice but to seek a suitable tenant to sublease the property for the duration of my lease. However, to my utmost dismay, your unwavering refusal to allow subleasing is highly unreasonable, given the circumstances of my departure. As stipulated in the lease agreement signed between both parties, subleasing is permissible, provided certain reasonable conditions are met. Yet, you have consistently disregarded my attempts to adhere to these conditions and have unjustly denied my requests without providing valid justifications. I would like to bring to your attention that my proposed subtenant is highly reliable, has excellent references, and has agreed to meet all the necessary requirements outlined in our lease agreement. In fact, this individual even expressed interest in signing a new lease with you after the sublease period concludes, which, I believe, is a testament to their suitability as a tenant. Moreover, denying my reasonable request for a sublease places an undue financial burden upon me. The circumstances leading to my move were unforeseen and beyond my control. It is only fair that I am afforded the opportunity to alleviate some financial stress through subleasing, as allowed in our legally binding lease agreement. By refusing my sublease proposal, I am left with no choice but to maintain financial responsibility for the property while incurring additional rental expenses elsewhere, which is an unfair and untenable situation. I kindly request that you reconsider and allow me to sublease the property in accordance with the lease agreement. I assure you that I have taken the necessary steps to find a responsible and suitable replacement tenant who will comply with all necessary requirements, maintaining the integrity of the property during their tenancy. In the event that you remain unwavering in your refusal to allow subleasing, I regrettably have no option but to escalate this matter further, seeking legal counsel and authorities to mediate our dispute. I sincerely hope it does not come to that, as I value the amicable relationship we have maintained thus far. I kindly request a prompt response to this letter within [reasonable timeframe]. Furthermore, I also urge that we engage in an open and constructive dialogue to achieve a fair resolution that benefits both parties involved. Thank you for your time and understanding. I am hopeful that we can find a mutually agreeable solution to this matter. Yours sincerely, [Your Name] [Tenant's Address] [Tenant's Contact Information]
