A party wall is a wall located on or at the division line between adjoining premises and used by adjoining landowners in the construction or maintenance of improvements on their respective properties. Generally, each owner of adjoining lands on which a party wall stands owns the part of the wall that stands on the owner's land and has an easement on the other part. Party wall interests are dependent on the terms of an agreement between the adjoining landowners. Unless the party wall agreement provides otherwise, the duration of the adjoining owners interests in the wall ordinarily continue as long as the wall stands. Party wall easements are terminated on the accidental destruction of the wall and, under some circumstances, on substantial changes in conditions of the neighborhood. The terms of the party wall agreement can provide for termination under other circumstances.

Si el vecino quiere adquirir la medianeria sobre esta paredes debe ponerse de acuerdo con el propietario de la pared, si no hay acuerdo no hay medianeria, por lo que tendra que levantar su propia pared, pues no podra utilizar la pared del vecino.

Un ejemplo recurrente de medianeria es la existencia del «muro medianero» entre dos predios colindantes, y que es definido en la norma tecnica G. 040, del Reglamento Nacional de Edificaciones -RNE (R.M. N° 029-2O21-VIVIENDA) como «paramento que pertenece en comun a dos predios colindantes.

El vecino podra en todo tiempo adquirir la medianeria de la parte nuevamente levantada, pagando la mitad del costo total de esta, y el valor de la mitad del terreno sobre que se haya extendido la pared medianera, segun el inciso anterior.

La medianeria existira cuando haya un elemento que divida dos fundos y que no haya sido levantado en terreno exclusivo de ninguno de ellos, sino en la linea divisora de ambos.

Para muros divisorios entre propiedades, tecnicamente llamado muro medianero que esta ubicado en el eje del deslinde (limite con el vecino), se debe respetar una altura minima de dos metros.

Dos inmuebles colindantes (inmuebles contiguos entre si) pueden estar separados, total o parcialmente, por paredes, cercos o zanjas divisorias. Se habla tambien de pared de cerco, pared o lindero, pared divisoria.

Art. 575: La reparacion y construccion de las paredes medianeras y el mantenimiento de los vallados, setos vivos, zanjas, y acequias, tambien medianeros, se costeara por todos los duenos de las fincas que tengan a su favor la medianeria, en proporcional derecho de cada uno.
