En mi calidad de trabajadora gestante, comunico que procedere a ejercer mi licencia por descanso prenatal por el periodo de cuarenta y nueve (49) dias naturales anteriores a mi fecha probable de parto fijada para el (2026 indicar dia, mes y ano2026) conforme al Certificado que adjunto a la presente.
Durante la licencia, la ANSES paga a la trabajadora la prestacion por maternidad (una de las asignaciones familiares previstas), que equivale al sueldo que cobra de manera habitual. Sin embargo, el empleador se lo debe pagar hasta que la licencia se haga efectiva.
La necesidad de haber cotizado durante el periodo de gestacion. El articulo 2.1.13.1 del decreto 780 de 2016 exige que, para pagar la licencia de maternidad, la trabajadora debe haber cotizado durante todo el tiempo de gestacion.

Esta licencia empieza a causarse aproximadamente dos (2) semanas antes de la fecha probable de parto y, de acuerdo con la Ley 1822 de 2017, en terminos generales, tiene una duracion de dieciocho (18) semanas calendario.
Como la licencia es de 18 semanas y cada semana tiene 7 dias, en total son 126 dias calendario de licencia o descanso remunerado por maternidad.
Es una suma mensual que puede cobrar la persona gestante desde el inicio de su embarazo hasta su interrupcion o el nacimiento del hijo. Se pueden cobrar 9 meses como maximo. La Asignacion por Embarazo para Proteccion Social se debe solicitar a partir de la semana de gestacion numero 12.
