Civ. Clausula legal por la que se contempla la prorroga automatica del contrato de arrendamiento urbano en determinadas circunstancias, atendiendo a la duracion del contrato, el tiempo transcurrido y la ausencia de comunicacion entre las partes sobre la renovacion.

Renovacion automatica del contrato de arrendamiento. «De no mediar constancia por escrito del preaviso, el contrato de arrendamiento se entendera renovado automaticamente por un termino igual al inicialmente pactado.» Ese preaviso se debe notificar con una antelacion no inferior a 3 meses.

Debido a la actual pandemia de COVID-19, los contratos se prorrogan automaticamente durante un periodo limite de seis meses, con las mismas condiciones. La prorroga extraordinaria puede aplicarse en aquellos contratos que finalicen entre el 2 de abril de 2020 y el 31 de octubre de 2021.

Se regula en el articulo 36 de la Ley de arrendamientos urbanos. Cuando termina el contrato de alquiler y el inquilino ha devuelto la vivienda el arrendador debe devolver la suma entregada. Entonces es un derecho de credito del inquilino; el deudor es el arrendador.

Diferencia entre prorroga y renovacion. De lo anterior se entiende que la renovacion implica un nuevo contrato con nuevas condiciones, en tanto la prorroga solo la extension del mismo contrato con las mismas condiciones.

Contrato de arrendamiento celebrado el 15 de julio de 2018 y que finaliza el 15 de julio de 2021. En este caso y por las mismas razones que en el ejemplo anterior, el inquilino podra pedir una prorroga extraordinaria por un periodo maximo de 6 meses, por lo que podra estar en la vivienda hasta el 15 de enero de 2022.

El articulo 3 del DNU 320/20 dispone que los contratos vencidos o a vencer antes del 31 de enero de 2021 (segun DNU 766/20) se prorrogan de forma automatica hasta que venza ese decreto, sin recargos de ningun tipo y pagando hasta el final el alquiler a valor de marzo.
