Agreements among family members for the settlement of an intestate's estate will be upheld in the absence of fraud and when the rights of creditors are met. Intestate means that the decedent died without a valid will.

Arbitration is a process in which the disputing parties choose a neutral third person, or arbitrator, who hears both sides of the dispute and then renders a decision. An arbitrator in effect acts as a private judge. Unlike litigation, arbitration proceedings are conducted in a private manner, and the rules of evidence and procedure are informal.
