As a general matter, cosmetologists are held to the standards of ordinary skill and ability possessed by those engaged in such businesses in the locality where the businesses are conducted. Accordingly, a cosmetologist may be held to be liable for injuries sustained by a customer resulting from his or her failure to meet such standards.
However, under certain circumstances, it may be appropriate for a cosmetologist to have a customer sign a waiver of liability indicating that the customer acknowledges there are no warranties, and assumes the risks involved in a certain treatment or process, and, further, will indemnify and hold cosmetologist harmless from and against any potential liability.
