Permutas. En las permutas de bienes o derechos, tributara cada permutante por el valor comprobado de los que adquiera, salvo que el declarado sea mayor, y aplicando el tipo de gravamen que corresponda a la naturaleza mueble o inmueble de los bienes o derechos adquiridos.

Segun el articulo 1278 del Codigo civil, no se necesita ningun tipo especial de forma para el contrato de permuta. Para su realizacion unicamente se requiere de la capacidad suficiente de las partes contratantes, su voluntad manifiesta y el acuerdo de las cosas a intercambiar.

Estos tienen la finalidad de permutar viviendas o bienes inmuebles (casas, pisos, apartamentos, etc.), bienes muebles (un coche o cualquier producto fisico) o derechos y servicios (de credito, de sucesion hereditaria, de usufructo, etc.).

El contrato de permuta se celebra entre dos partes, que deben ser propietarias de los bienes objeto de intercambio y este se hara sin intervencion de dinero, salvo excepciones. La permuta puede ser de objetos muebles o inmuebles y la pueden realizar tanto particulares como empresas.

El primer paso para realizar la permuta de casas o departamentos es que ambos duenos cuenten con una propiedad del mismo valor en el mercado. Sin embargo, si no poseen el mismo valor, existe la posibilidad de que el dueno de la casa con valor inferior pague la diferencia en dinero al otro propietario.

El procedimiento para permutar inmuebles entre particulares es relativamente sencillo si no hay hipotecas pendientes en las viviendas. Para ello, se pacta el valor de ambos inmuebles, ya sea el valor de mercado o el de tasacion. Acto seguido, se firma ante notario una escritura de permuta.

Caracteristicas del contrato permuta Los contratantes deben ser propietarios del bien mueble o inmueble que intercambiaran, de lo contrario, se obligan a devolver el bien recibido. Al celebrarse el contrato de permuta, se transmite la propiedad a la contraparte del bien materia del intercambio.

Relacion con la compraventa El contrato de permuta puede darse si la equivalencia del precio del bien de la otra persona esta saldado mas de un 51% en especie (bienes evaluados en dinero) y el resto puede ser en dinero. Si el 51% es dinero ya no es permuta sino compraventa.

La permuta inmobiliaria es un contrato en el que dos partes intercambian un inmueble de su propiedad. Se puede considerar como un trueque, aunque normalmente la valoracion de ambos inmuebles no es identica. Por lo tanto, una de las partes tambien aporta dinero.
