The defense contended that because the defendant was not entitled to a juror instruction on that doctrine at the point of jury selection, that jury instruction was inadequate for his client. The trial court found that the defense received a copy of that instruction from the trial judge, that it was not given to any of the members of the panel before they were sworn in, that it did not include an “indifference” reference, and that at the conclusion of the motion hearing, the attorneys for the defendant and the defense did not know which jurors were not informed. The court further concluded that this evidence was adequate to constitute prejudice to the defendant; therefore, the jury instructions were deficient.
