Renovacion automatica del contrato de arrendamiento. «De no mediar constancia por escrito del preaviso, el contrato de arrendamiento se entendera renovado automaticamente por un termino igual al inicialmente pactado.» Ese preaviso se debe notificar con una antelacion no inferior a 3 meses.

Cuando el plazo del contrato vence, el inquilino no queda sin contrato, queda con contrato vigente con plazo vencido. Puede continuar alquilando la vivienda el tiempo que lo desee, siempre y cuando el propietario no pida renovar el plazo y el monto. La renovacion es un acuerdo entre ambas partes.

Los contratos de trabajo con duracion inferior a un ano deben renovarse por minimo un ano a partir de la cuarta renovacion. La cuarta renovacion de un contrato inferior a un ano sera por minimo un ano, ya sea que la renovacion se de automaticamente o por acuerdo expreso entre las partes.

La carta de terminacion de un contrato debe incluir la fecha, el nombre del inquilino y el arrendador, los datos del inmueble en cuestion (con direccion y especificaciones), la solicitud explicita de terminacion del contrato y la fecha en la cual se finaliza el acuerdo.

Cuando el arrendador no desea renovar el contrato de arrendamiento al arrendatario, debe notificarle su decision en los plazos que senala la ley segun el tipo de inmueble arrendado, como puede ser una vivienda o un local comercial, notificacion que se hace mediante una carta de aviso, por llamarla de algun modo.

Es la estipulacion contractual en la que se conviene que, el plazo contractual se prorrogara por un termino igual al inicialmente convenido, sin necesidad de formalidad alguna.

La Real Academia Espanola, define la prorroga como la continuacion de algo por un tiempo determinado, mientras que la renovacion como la accion y efecto de renovar, sustituir, modificar, reanudar.

Segun la Ley, el arrendatario debe hacer este preaviso por escrito a traves de un servicio postal autorizado y con una antelacion no menor a tres (3) meses a la fecha de vencimiento del contrato de arrendamiento.

Si usted es un inquilino a voluntad (sin un contrato de alquiler escrito), el dueno puede desalojarlo sin dar ninguna razon. Sin embargo, el tiene que entregarle una notificacion escrita con 7 o 30 dias de anticipacion. Hay algunas excepciones a esta regla que seran explicadas mas abajo.

Debe darse el aviso con una antelacion no menor de tres meses a traves del correo del servicio postal autorizado. Del mismo modo el tiempo que tiene un inquilino para desocupar un inmueble es de tres meses desde la fecha de aviso.
