El articulo 21.4 LAU establece que «las pequenas reparaciones que exija el desgaste por el uso ordinario de la vivienda seran de cargo del arrendatario«, es decir, del inquilino. Este articulo es aplicable a los contratos de vivienda habitual, pero no a los arrendamientos de locales, contratos de temporada, etc.

Reparaciones o mejoras locativas: podemos citar una puerta rota por golpes, pintura sucia cuando el inmueble se entrego con paredes recien pintadas, vidrios rotos por culpa de este, danos en accesorios de cocina, banos, etc., cuando hubieren sido entregados en buenas condiciones por el arrendador.

Son reparaciones que no son consideradas indispensables para que la vivienda o local de negocio siga cumpliendo su condicion de habitabilidad o su finalidad de servir de vivienda al inquilino. Tambien se les llama a estas pequenas reparaciones obras menores, y suelen ser de escaso importe.

El propietario esta obligado a asumir las reparaciones necesarias para que la vivienda este en condiciones de habitabilidad. Estas obras no incidiran en el aumento del precio del alquiler. Al propietario le corresponde ocuparse del mantenimiento de suelo, paredes y techos.
