Description

Section 807 of the Fair Debt Collection Practices Act, 15 U.S.C. Section 1692e, provides, in part, as follows: "A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section:

"(8) Communicating or threatening to communicate to any person credit information which is known or which should be known to be false, including the failure to communicate that a disputed debt is disputed."

[Your Name] [Your Address] [City, State, Zip Code] [Date] [Debt Collector's Name] [Debt Collector's Address] [City, State, Zip Code] Subject: Disputing False or Misleading Misrepresentations in Collection Activities Dear [Debt Collector's Name], I am writing this letter to bring to your attention some serious concerns I have regarding the manner in which you have been handling my debt collection. I recently became aware of several false or misleading misrepresentations made by your agency, [Debt Collection Agency Name], which are in violation of the Fair Debt Collection Practices Act (FD CPA) and relevant laws. Firstly, I would like to dispute the false credit information that has been communicated or threatened to be communicated to various individuals. This includes but is not limited to misleading statements regarding the status of my debt, its amount, the consequences of non-payment, and any potential actions you intend to take against me. Your agency has failed to provide accurate and transparent information, which constitutes a violation of the FD CPA. Furthermore, I must emphasize that you have neglected to communicate that this debt is currently under dispute, as required by law. As per the FD CPA, upon receipt of a consumer's written dispute, you are obligated to notify any credit reporting agencies to whom you have reported the debt about its disputed status. Failure to do so not only tarnishes my credit report but also breaches your legal obligations as a debt collector. I kindly request that you cease all further collection activities until these matters are resolved. Additionally, I urge you to rectify the false and misleading information you have provided to any credit reporting agencies, ensuring my credit report accurately reflects that this debt is under dispute. I have taken the liberty of documenting all instances of false or misleading misrepresentations made by your agency, including dates, times, and names of the respective representatives involved. Enclosed with this letter, you will find copies of supporting documentation as evidence of the inaccuracies in your collection activities. Please consider this letter as a formal notification of your illegal collection practices, and I kindly ask you to rectify the situation promptly. Failure to address these violations will leave me no choice but to pursue legal remedies available to me, including filing a complaint with the Consumer Financial Protection Bureau and seeking legal counsel. I expect a prompt response from your agency within [30 days from the date of this letter] to ensure that all necessary actions have been taken to correct the aforementioned violations. Your acknowledgement and resolution of this matter will only serve to mitigate the potential consequences your agency may face in the future. Thank you for your immediate attention to this matter. I trust that you will handle this dispute with the seriousness and professionalism it requires. Your prompt action in addressing these issues will be greatly appreciated. Sincerely, [Your Name]
