Travis Texas: Letter Informing Debt Collector of False or Misleading Misrepresentations in Collection Activities — Communicating or Threatening to Communicate to any Person False Credit Information, Including the Failure to Communicate that a Debt is Disputed Dear [Debt Collector's Name], I am writing this letter to inform you of the false or misleading misrepresentations in your collection activities that have come to my attention. It has come to my notice that you have been communicating or threatening to communicate false credit information to various individuals, failing to disclose the disputed nature of the debt in question, which is both unethical and a violation of the Fair Debt Collection Practices Act (FD CPA). As a debtor, it is my right to dispute any debts that I believe to be inaccurate or invalid. Under the FD CPA, debt collectors are obligated to provide accurate and truthful information about the debts they are attempting to collect. Your failure to communicate that the debt I am disputing is indeed disputed is a direct violation of this obligation. Additionally, by communicating false credit information to other parties, you are not only damaging my creditworthiness but also engaging in deceptive practices that can harm my reputation. This behavior is unacceptable, and I insist that it be rectified immediately. I expect you to take the following actions: 1. Cease all communication regarding this debt to any party other than myself, as is my right under the FD CPA. 2. Amend your records to accurately reflect that the debt is disputed. This includes updating any credit reporting agencies you may have provided false credit information to. 3. Provide written confirmation, within 30 days of receiving this letter, that you have complied with the above requests and that no further collection activities will take place until the disputed debt is validated. Failure to comply with these requests may result in legal action being taken against your agency. I have consulted with legal advisors who are aware of this situation, and they are prepared to take necessary action to protect my rights. Lastly, please note that this letter is being sent via certified mail with return receipt requested, and I expect your response to be sent using the same method. This will provide evidence of our communication and your receipt of this letter. I hope that we can resolve this matter in a fair and amicable manner, ensuring that my rights as a debtor are respected. I look forward to receiving your prompt response and a quick resolution.
