Description

Section 807 of the Fair Debt Collection Practices Act, 15 U.S.C. Section 1692e, provides, in part, as follows: "A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section:

"(10) The use of any false representation or deceptive means to collect or attempt to collect any debt or to obtain information concerning a consumer."

This would include asserting that the debt collector cannot accept partial payments when they have been authorized.

Travis Texas Letter Informing Debt Collector of False or Misleading Misrepresentations in Collection Activities — Using False Representation or Deceptive Means to Collect a Debt — Asserting that the Debt Collector Cannot Accept Partial Payments When They Can Dear [Debt Collector's Name], I am writing this letter to bring to your attention certain false or misleading representations made by your agency in relation to the collection of a debt that you claim I owe. It has come to my attention that your agency has been using deceptive means and false representations to collect this alleged debt. Firstly, I would like to clarify that I am well aware of my rights as a debtor and the options available to me when it comes to repaying this debt. Despite your assertions, I am fully aware that you have the ability to accept partial payments towards the outstanding balance. Your attempts to mislead and deceive me by asserting that you cannot accept partial payments are in violation of the Fair Debt Collection Practices Act and other relevant laws. Such deceptive tactics not only create unnecessary confusion, but they also undermine the credibility of your agency. Furthermore, I demand that you immediately cease and desist from any further collection activities until the matter is resolved. It is my right as a consumer to be provided with accurate and truthful information about my debt, including the option to make partial payments if necessary. I am fully prepared to take legal action and report your agency's debt collection practices to the appropriate authorities if these false representations and deceptive tactics continue. I have documented evidence of the false statements made by your agency, and I encourage you to reconsider your actions and comply with the law. Therefore, I hereby request that you provide me with a detailed breakdown of the alleged debt, including any interest and fees that have been added to the original amount. I also insist on receiving written confirmation from your agency, explicitly stating that you acknowledge your ability to accept partial payments towards the outstanding balance. Failure to comply with these requests within [reasonable timeframe, e.g., 30 days] will leave me no choice but to pursue all available legal remedies to address this matter. I trust that you will act promptly and responsibly to rectify this situation and ensure that your future debt collection activities are conducted in a lawful and ethical manner. Please consider this letter as my firm and final warning. I expect a prompt response and appropriate actions taken to rectify the false and misleading misrepresentations made by your agency. Sincerely, [Your Name] [Your Address] [City, State, ZIP] [Phone Number] [Email Address] Keywords: Travis Texas, letter, informing, debt collector, false/misleading misrepresentations, collection activities, false representation, deceptive means, debt, asserting, cannot accept partial payments.
