A debt collector may not use unfair or unconscionable means to collect or attempt to collect any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section:

"(6) Taking or threatening to take any nonjudicial action to effect dispossession or disablement of property if: (A) there is no present right to possession of the property claimed as collateral through an enforceable security interest . . . . (B) there is no present intention to take possession of the property."

Subject: Urgent Notice — Informing Debt Collector of Unfair Practices Dear [Debt Collector's Name], RE: Unfair Practices in Collection Activities — Cease Nonjudicial Actions I am writing this letter to express my serious concern regarding the unfair practices in collection activities that I have experienced with your company. It has come to my attention that you have taken or threatened to take nonjudicial action, despite having no present right or intent to exercise such rights in relation to my outstanding debt. As a resident of Fairfax, Virginia, it is imperative for me to emphasize that such actions are in direct violation of the Fair Debt Collection Practices Act (FD CPA). I am aware of my rights as a consumer, and I intend to protect them. Your actions not only violate the FD CPA, but they also create unnecessary stress and anxiety during an already difficult financial situation. Therefore, I kindly request that your company immediately ceases all nonjudicial actions related to the collection of my debt. In the interest of resolving this matter amicably, I request the following: 1. Confirmation in writing that your company will no longer take or threaten any nonjudicial action where there is no present right or intent to exercise such rights. 2. Ensure that any pending nonjudicial actions against me are suspended or withdrawn. 3. Cease all forms of harassment or unfair practices in connection with the collection of my debt. 4. Provide me with written documentation stating the current total amount of my remaining debt, along with a breakdown of any additional interest or fees. Please note that failure to comply with my requests within [reasonable time frame, such as 14 days] will leave me no choice but to take legal action to protect my rights and seek any necessary remedies available to me under the law. Should you require any further documentation or information from my end, please do not hesitate to contact me at [your contact number] or [email address]. I expect that our future communication will be conducted in a professional and respectful manner. I strongly believe in fair and ethical debt collection practices and trust that your company will rectify this matter promptly. Your cooperation is greatly appreciated.
