Salt Lake Utah Letter Informing Debt Collector of Unfair Practices in Collection Activities — Taking, or Threatening to Take, any Nonjudicial Action Where there is no Present Right or Intent to Exercise such Rights Dear [Debt Collector's Name], Subject: Unfair Practices in Collection Activities — Nonjudicial Action— - Immediate Cease and Desist I am writing to address a matter of considerable concern regarding your collection activities pertaining to the debt associated with [account number]. After thorough research and consultation with legal experts, I have come to realize that your actions may potentially violate federal and state laws, specifically those pertaining to nonjudicial actions without a present right or intent to exercise such rights. Under the Fair Debt Collection Practices Act (FD CPA) and relevant Utah state laws, debt collectors are prohibited from engaging in unfair, deceptive, or abusive practices in the collection of debts. In particular, Section 1692f(6) of the FD CPA explicitly prohibits the collection of any amount not authorized by law or contract, and Section 1692e(5) bars the threat to take action that cannot legally be taken or that is not intended to be taken. In light of these legal provisions, I have reason to believe that your recent actions go against the aforementioned regulations. Furthermore, I request that you provide written confirmation within [reasonable timeframe, e.g., 14 days] from the date of this letter, acknowledging your receipt of this notice and affirming your commitment to cease all collection activities that violate the FD CPA and relevant Utah state laws.
