A debt collector may not use unfair or unconscionable means to collect or attempt to collect any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section:
"(7) Communicating with a consumer regarding a debt by post card."
Miami-Dade Florida Letter Informing Debt Collector of Unfair Practices in Collection Activities — Communicating with a Consumer Regarding a Debt by Post Card Dear [Debt Collector's Name], I am writing to bring to your attention my concerns regarding the unfair practices I have experienced in relation to the collection activities regarding my debt. As a resident of Miami-Dade County, Florida, I am aware of my rights and protections under both federal and state laws, and it is important to address these issues promptly. Firstly, I want to express my disappointment with the debt collection communication method you have employed, specifically using a post card to inform me about my debt. This communication method not only jeopardizes my privacy but also poses a potential security risk. The sensitive nature of financial information, such as debt collection matters, requires that all communications are conducted via secure and private channels. The use of post cards clearly violates my right to privacy and can expose my personal financial matters to unintended recipients. Furthermore, this communication method also violates various state and federal laws concerning debt collection practices. The Fair Debt Collection Practices Act (FD CPA) sets clear guidelines for how debt collectors should communicate with consumers. Section 805(a)(1) of the FD CPA states that debt collectors shall not use any language or symbol on any envelope or in the communication that indicates the debt collector's business or the purpose of the collection effort, except for communicating with consumers who reside in states that do not prohibit such communication. However, Miami-Dade County, Florida, is not exempt from this provision, and using a post card clearly violates the FD CPA. Additionally, the Florida Consumer Collection Practices Act (FC CPA) imposes further restrictions on debt collectors' activities. Section 559.72(9) of the FC CPA prohibits any communication by a debt collector that violates the privacy of the debtor, such as disclosing any personal information related to the debt. Using a post card to communicate about a debt disregards this protection provided under state law. Considering the aforementioned violations of both federal and state laws, I kindly request that you cease all communication with me regarding this debt using post cards immediately. Instead, I ask that you contact me in writing via a secure and confidential method, such as regular mail or email, ensuring that all communication remains private and confidential. Please take this matter seriously and address these concerns within [provide a reasonable timeframe, e.g., 15 business days] of receiving this letter. Failure to do so will leave me with no choice but to report the unfair practices and violations to the appropriate authorities, including the Consumer Financial Protection Bureau and the Florida Office of Financial Regulation. I trust that you will rectify this situation promptly to avoid any further legal action. Thank you for your attention to this matter. I look forward to your prompt response.
