Is a resident of the State of Florida on July 1, 1986; or. 4. Is a nonqualified alien and is employed as an independent contractor in a business activity established or carried out in the State of Florida on January 1, 1985. Sections 1202 and 1203 also do not apply to an independent contractor who: 1. Is compensated by commissions by a labor organization other than in a bona fide representative capacity; 2. Has been employed by the Florida State College of Optometry or the University of Florida for more than one day during the preceding calendar year; and. 3. Is an out-of-State student enrolled in any programs of study at an institution of higher education (including a technical institution as defined in Section 1202.
