El endoso es un medio cambiario mediante el cual el tenedor o acreedor cambiario cede en favor de alguien una letra u otro documento de credito, recogiendolo por escrito al dorso y senalando que ha de pagarse a ese nuevo acreedor o a un tercero en su nombre.
Todo endoso debe ser firmado por la persona que lo extiende y la firma hecha por mandato de otro debe indicar esa circunstancia. Adicionalmente, un cheque endosado puede ser reendosado mediante una segunda firma. Solo se pueden endosar los cheques que se haya girado a la orden.
La persona beneficiaria, conocida como endosante y que tiene el cheque en su poder, debe firmarlo en el dorso para hacer oficial su cesion. Si solo firma y no especifica el nombre del endosatario, es decir, de la persona a la que cede el cheque, sera un endoso en blanco.
El endoso debe constar en el titulo relativo o en hoja adherida al mismo, y llenar los siguientes requisitos: El nombre del endosatario; La firma del endosante o de la persona que suscriba el endoso a su ruego o en su nombre; La clase de endoso; El lugar y la fecha.
El endoso, ordena la ley, debe ser puro y simple. Toda condicion a la cual se subordine, se tendra por no escrita. El endoso parcial es nulo (articulo 32, LGTOC).
Formalidad no esencial puesto que de la combinacion de dos normas (articulos 30 y 32, LT) si se omite dicho nombre, el endoso surte efectos de endoso en blanco; esto mismo prescribe la ley para un endoso al portador; sin embargo, para que la transmision cambiaria y nominativa sea perfecta debera consignarse el nombre
El endoso se realiza con una referencia escrita en el propio titulo, o en un anexo, indicando Paguese a: y anadiendo el nombre o razon social del nuevo beneficiario, la fecha y la firma del endosante, que es la que legitima el traspaso entregando el original al nuevo dueno.
