As the final arbiter of the law, the Court is charged with ensuring the American people the promise of equal justice under law and, thereby, also functions as guardian and interpreter of the Constitution.

The Supreme Court has unlimited jurisdiction to hear and determine any civil or criminal proceedings under any law other than a disciplinary law and such jurisdiction and powers as may be conferred upon it by the Constitution or any other law. (Section 76(1) of the Constitution).

As per Article 76 of the Constitution of Mauritius, the Judges of the Supreme Court are the Chief Justice, the Senior Puisne Judge and such number of Puisne Judges as may be prescribed by the National Assembly.

The President of the Republic of Mauritius Prithviraj Roopun appointed Rehana Bibi Mungly-Gulbul to the position of chief justice on Tuesday, marking the first time that a woman has ascended to the highest position in the Mauritian judiciary.

(1) The Supreme Court shall be the principal court of original criminal jurisdiction and shall exercise general powers of supervision over all Intermediate, District and Industrial Courts and any other special courts that are or may be established in Mauritius.

The Constitution of the Republic of Mauritius (French: La Constitution de Maurice) is the supreme law of Mauritius, ing to Chapter I, Section 2 of the constitution, if any other law is inconsistent with this Constitution, that other law shall, to the extent of the inconsistency, be void.

The Supreme Court was established as a supreme body composed of the Prime minister, President, three judges, four clerks and a government commissioner where appeal from neighbouring Seychelles was also allowed.
