Under Section 1135 of the Social Security Act (the Act), the Secretary can waive certain requirements related to Medicare, Medicaid, and the State Children's Health Insurance Program (CHIP) to ensure that sufficient health care items and services are available to meet the needs of enrollees in affected areas.

A benefit period begins the day you're admitted to the hospital or skilled nursing facility. In this case, it only applies to Medicare Part A and resets (ends) after the beneficiary is out of the hospital for 60 consecutive days. There are instances in which you can have multiple benefit periods within a calendar year.

The Model Waiver, a program started in Maryland in 1985, allows medically fragile individuals who would otherwise be hospitalized and are certified as needing either hospital or nursing facility level of care to receive medically necessary and appropriate services in the community.

This stipulated that for Medicare to cover services provided in a skilled nursing facility (SNF), the patient required at least three, consecutive midnights of inpatient care in an acute hospital setting.

The top states—ranked from 1 to 10—are Massachusetts, Nebraska, Vermont, Alaska, Wisconsin, Rhode Island, Minnesota, New York, Washington, and New Hampshire.

For days 21–100, Medicare pays all but a daily coinsurance for covered services. You pay a daily coinsurance. For days beyond 100, Medicare pays nothing. You pay the full cost for covered services.

If your break in skilled care lasts more than 30 days, you need a new 3-day hospital stay to qualify for additional SNF care. The new hospital stay doesn't need to be for the same condition that you were treated for during your previous stay.

The 3-day rule requires the patient have a medically necessary 3-consecutive-day inpatient hospital stay, which doesn't include the discharge day or pre-admission time spent in the emergency room (ER) or outpatient observation.
