(d) As a foreign carrier, if you operate a charter flight from a foreign airport to a U.S. airport, and return to a foreign airport, and you do not pick up any passengers in the U.S., the charter flight is not a flight subject to the requirements of this part.

Part 135 effectively prevents an operator or agent from selling single seats on charter flights because all flights must be “on- demand.” A Part 380 (public charter) operator may sell single seats.

Public Charters. Typically, a public charter exists when a person or company contracts for the operation of an aircraft to and from a destination and then advertises and sells seats to members of the public, either directly or through a travel agent.

Overview. Part 380 of the U.S. Department of Transportation's (DOT) regulations (14 CFR Part 380) requires all persons who wish to arrange public charter flights to first submit a charter prospectus to the Special Authorities Division with the required information about the proposed charter program.
