Indiana law recognizes a person's right to consent to health care if the individual is an adult, an emancipated minor, a 14-year-old person under certain circumstances, or a 16-year-old female under certain conditions involving pregnancy, birth, and labor. Ind. Code §§ 16-36-1-3(a) and 16-36-1-3.5(b).

A person 16 years of age or older or a person younger than 16 years of age who is or has been married may give his/her consent when requesting admission to an inpatient mental health facility by filing a request with the administrator of the facility to which admission is requested.

There physicians are often faced with the question of just who may consent to treatment and under what circumstances? In most states, age 18 is the age of majority and thus, before treating a patient under the age of 18, consent must be obtained from the patient's parent or legal guardian.

If you are a minor (under 18), a parent or legal guardian must consent to medical treatment for you in most cases. There are exceptions. In general, you can only consent to your own medical, dental, psychological, and surgical treatment if you are at least 16 years old and you live on your own.

Youth age 18 years or older may consent to their own health care. Therefore parental consent is not required. Exception: For youth age 18 years or older deemed incompetent or unable to consent, DCS will obtain a court order prior to authorizing non-routine health care treatment.

In Texas, some minors (under the age of 18) are required to obtain consent (click to print consent form in English or Spanish) from a parent or guardian before receiving certain medical services at our health centers.

MINORS CAN CONSENT TO TREATMENT BY A PHYSICIAN OR DENTIST WHEN THE MINOR IS: On active duty with armed services. 16 years old or older and residing apart from parents, managing conservator or guardian and managing his or her own financial affairs.
