Get Notarized Lien Release

There are just 3 states where lien waivers must be notarized: Texas, Wyoming, and Mississippi.

To remove a lien recorded on a paper title, you will need: the vehicle title. a release of lien letter and/or other notifications from the lienholder(s) currently named on the vehicle title. a completed Application for Texas Title and/or Registration (Form 130-U)

In Texas, when the borrower's obligations under the deed of trust are fully satisfied, the lien of the deed of trust is discharged by recording a release of lien (release). A release must be recorded with the county recorder for the deed of trust to be discharged from the public records.

"Individuals buying a home, adopting a child, completing estate planning documents, such as wills and advanced health care directives, or completing any number of legal procedures may find themselves in need of a notary."

Per these new adjustments, notarization is no longer a requirement for lien waivers, providing much needed administrative relief to the construction industry in Texas. These changes to the Texas Property Code took effect on January 1, 2022.

As far as lien waivers, the vast majority of states don't require notarization. Florida, in particular, has some unique laws concerning lien waivers – and Florida statute doesn't require lien waivers be notarized, but that doesn't mean a lien waiver in Florida might still need notarization to be valid.

You may apply for a clear title in person at any of the MVA's full-service branch offices or by mail to the MVA's title file unit. You must submit the Maryland Notice of Security Interest Filing (SIF) and/or the lien release letter you received, plus the current title for your vehicle.

When perfecting liens, a lienholder uses a third-party service provider to release the lien. When the lien(s) are being satisfied, the third-party service provider will forward lien satisfactions from the lienholder to the department and will receive an electronic confirmation from the department.
