The Transient Occupancy Tax (TOT) is a tax of 12% of the rent charged to transient guests in hotels/motels, including properties rented through home sharing services like Airbnb, located in the unincorporated areas of Los Angeles County.

Rates. The state hotel occupancy tax rate is 6 percent (. 06) of the cost of a room. Cities and certain counties and special purpose districts are authorized to impose an additional local hotel tax that the local taxing authority collects.

The 6 percent state hotel tax applies to any room or space in a hotel, including meeting and banquet rooms. Local hotel taxes, however, are due only on those rooms ordinarily used for sleeping.

Any rentals for less than thirty days are considered to be subject to a gross rental receipts tax at the rate of 10%. It must be noted that for rentals lasting longer than thirty days, the rate will be 6.25%. Sales of tangible media property are subject to sales tax in Texas.

The collection and remittance of Texas state hotel occupancy tax is required for all short-term rentals (unless an exemption applies). Although Airbnb is handling the tax for bookings on its site, Hosts are still required to collect and remit the tax for bookings made on non-Airbnb rentals.

The State of Texas imposes a 6% (0.06) state hotel occupancy tax for stays of 29 consecutive calendar days or less. This tax needs to be filed and paid monthly or quarterly. The frequency and the due dates are determined when you register with the Texas Comptroller Office.
