(b) Except as hereinafter provided, a child entering school or a state-regulated child care center in this state must be immunized against chickenpox, hepatitis-b, measles, meningitis, mumps, diphtheria, polio, rubella, tetanus and whooping cough.

In order for any exemption request to be granted, the request must be approved by the employer and the COVID-19 Religious Exemption Review Committee. The request form must be received no later than September 15, 2021.

HCWs whose religious beliefs prevent them from obtaining the COVID-19 vaccination must submit the Religious Exemption Request Form to WVUHS Employee Health. The request will be reviewed and ultimately referred to the local employer for final disposition.

(i) A physician who provides any person with a false certificate of immunization against chickenpox, hepatitis-b, measles, meningitis, mumps, diphtheria, polio,, rubella, tetanus and whooping cough is guilty of a misdemeanor and, upon conviction, shall be fined not less than $25 nor more than $100.

State law and rules1 require that all children entering school in West Virginia for the first time in grades K-12 must show proof of immunization against diphtheria, pertussis, tetanus, polio, measles, mumps, rubella, varicella, and hepatitis B unless properly medically exempted2.

A medical exemption is allowed when a child has a medical condition that prevents them from receiving a vaccine.
