Tier2 Submit™ is a program to help facilities prepare electronic versions of the Tier II hazardous chemical inventory form that are required annually under the Emergency Planning and Community Right-to-Know Act (EPCRA).

Tier II Chemical Reports give information about the facility, hazardous chemicals, and emergency contacts. Facilities must keep their most current Tier II Report until they file a new report, which then becomes the most current. The TCEQ, Tier II Chemical Reporting Program must keep all Tier II Reports for 30 years.

Tier II information provides the state and local officials and the public with specific information on the amounts and location of hazardous chemicals present at a facility during the previous calendar year.

Tier II Reporting Exemptions Substances that are solid and don't cause any exposure during normal use are often exempt from reporting.

A: Chemicals reportable under the EPCRA Section 312 Tier II requirements include any substance for which a facility must maintain a Material Safety Data Sheet (MSDS) or Safety Data Sheet (SDS) under the OSHA Hazard Communication Standard (29 CFR 1910). Over 500,000 products are required to have a MSDS/SDS.
